Original Question Sally and Bob are neighbors. Sally is seriously injured when a tall and apparently healthy tree located on Bob’s private property falls on Sally while she sat on her front porch. Assume that Sally sues Bob based on a claim of negligence. In your initial post, explain if Bob is legally responsible for Sally’s injuries. After submitting your post, respond to the posts of at least two classmates.

When a person is injured by a falling tree, there are many distinct factors that can affect who will be held liable. You would need to prove negligence. Negligence is about breaching the duty we owe to others. Somethings to think about when a tree falls is who was responsible for maintaining the tree and whether the injured person was acting carelessly.

Even though Sally was seriously hurt, she would have to prove that her neighbor was negligence in properly maintaining the tree and she would need to establish that Bob owed a duty to her. He does have an owed duty to her, so Bob is legally responsible for Sally’s injuries. Trees do not just fall without a reason.
