HSES 884 Jayhawkville West High School Sued by A Group of Parents Case Study
Jayhawkville West High School has recently been sued by a group of parents due to the school’s policy prohibiting students from wearing green wristbands during football games. Green has come to symbolize the parents’ and students’ frustration with Principal Hartright and his inconsistent decision making. The school administration contends this is a health and safety issue and has nothing to do with constitutional law issues. They state it promotes arguments with the students and other staff who support the principal. Additionally, green is not one of the school’s colors. They have further stated that continuing to wear them would result in being dismissed from the football team.
The students and parents state that this is a violation of the students’ rights. They do not think it is a health and safety issue as no fights have occurred because of them and wearing them on the field of play only minimally increases the chance of injury. (e.g., if grabbed and pulled during a tackle, the student may only get a slight burn which is much less serious than other risks of playing football).
Choose which side of the argument you are on and draft a document that lays out your positions and refutes the other side’s.
Items within your paper should include:
- A discussion as to whether there is state action in this scenario.
- A discussion on the First Amendment and how/if it applies in this situation.
- A discussion on Due Process and how/if it applies in this situation.
- A discussion as to why your position is correct and why the other position is incorrect.
- Four sources which can include cases and other material contained in this module.
