Following the events of September 11, 2001, in which four airplanes crashed as a result of the presence of terrorists on those flights, the FAA concluded that it needed to implement new procedures for airports and flights. The new procedures for security and flights took effect when the airports reopened five days later. Why did the FAA not need to go through the promulgation and public comment processes and time periods to have the new rules take effect?

Generally before implementing new regulations, all agencies and businesses must go through the promulgation and public comment process. This process involves vigorous research and public review and response to the rule or rules in question. Throughout the process, there are various levels in which the draft proposal must go through numerous reviews and corrections before it can reach judicial and congressional review for approval. Although the process is required by law, it can be a long undertaking that takes quite a bit of time. However, because the events that occurred on September 11th were considered to be terrorist attacks, the FAA needed to respond quickly in order to protect the general public. Time was of the essence and the government needed to make a decision as soon as humanly possible. Due to the urgency of the security regulations in question, the government allowed the FAA authority to adjust the security rules accordingly. Therefore they were able to bypass the normal process in order to protect anyone and everyone that would fly after the September 11th events.

It is required by agencies to make public comments and go through promulgation when a new regulation is put forward. Research is part of the systematic process of review before enacting a new rule, as well as research as a public review which follows research. The FAA failed to comply to these requirements following the September 11th terrorist’s attacks. However, after these attacks’ decisions needed to be made quickly. In a state of emergency that implemented danger to the community a regulatory reform on security needed to be enacted as quick as possible. Reason being why the FAA had authority to make new rules regulating and enforcing security measures to restore and sustain safety.
