This doesn’t hold perfectly year to year but over an average of a few years it does. Does this mean that mass incarceration is the answer to crime control? Research this topic and provide statistics and analysis to show a clear picture of what is actually happening.

Chandler is a third-year law student in the state of Despair and is in the process of filling out his bar application. One question asks if the applicant has ever been convicted of a crime, including traffic-related violations. Chandler has a misdemeanor drunk driving conviction on his record. Chandler convinces himself that the authorities are really concerned only with felony convictions, and he answers no to the question. Six months later, Chandler takes and passes Despair’s bar examination and joins a large downtown law firm as an associate.
Chandler becomes friendly with Ross, another associate at the firm. One night, Chandler and Ross go out to dinner. Over drinks, Chandler confesses that he was once arrested and convicted for drunk driving. Ross asks him, “How did you handle that on your application for the bar?” Laughing, Chandler says, “Those knuckleheads never found out about the conviction. I didn’t put it on my application and they never asked.” The next day, now sober, Chandler notices that Ross is keeping his distance and acting remote and unresponsive. Fearful that Ross will report him to the grievance committee, Chandler goes to see Joey, an old family friend and well-known criminal defense attorney. Chandler asks Joey for advice on what to do now that Ross knows about the drunk driving conviction. Joey advises Chandler to notify the state bar about the conviction. Joey says, “Confession before Ross reports you is the best step. You’ve had a good record since you were admitted and the Committee may take no action. But you have to tell them.” Chandler leaves Joey’s office and does not notify the bar. Neither Ross nor Joey ever reports Chandler to the bar.
A year later, Chandler decides to move to the state of Nirvana. The bar application in Nirvana asks only if there have been any prior felony convictions. Chandler honestly replies no. Chandler asks Joey to write a letter of recommendation for his admission to the Nirvana state bar. Joey consents and sends the letter to the bar. Joey says nothing about his interview with Chandler or about his conviction. Chandler is admitted to practice law in the state of Nirvana.

Week 4 Project: Prisoners’ Rights

An offender was sentenced for two years for his third grand theft, and was moved to a state prison. During his second week, he was subjected to abuse and humiliation—hazing—from some other prisoners. This treatment continued unchecked, so he informed prison guards on two separate occasions of the abuse during his third week. The prison guards ignored his complaints because they did not want to upset the customary prison ritual of older prisoners scaring the new ones. The guards assumed that he would eventually fit into the prison culture.
However, his complaints led to him being beaten up by other prisoners. He pleaded with a prison guard to transfer him to another wing in the prison because of the continued abuse he was receiving. The authorities denied his request. He was ultimately raped and beaten repeatedly by several prisoners over a span of two weeks before being transferred. He also contracted two sexually transmitted diseases during the assaults. Subsequently, he brought a suit against the state for cruel and unusual punishment.
Conduct research about prisoners’ rights, conditions of the incarcerated, and prisoner abuse. Using Microsoft Word, submit a 4- to 6-page analysis of the case that answers the questions listed below.

• Explain the conditions under which prisoners have a right to sue the state based on violations of their constitutional rights. Specify the constitutional rights granted to prisoners. In which conditions are these rights denied?
• Describe the concept of “legitimate penological objectives” and how it figures into inmate lawsuits.
• Did the prison officials show “deliberate indifference” to the prisoner in this scenario under Wilson v. Seiter (1991)? If yes, can the prison guards be held responsible individually for the harm caused to the prisoner due to their indifference? Explain. If no, why?
• Could the victim win a lawsuit against the state by seeking protection under the Eighth Amendment? Use the case law of Farmer v. Brennan (1994) to frame your response.
