Chapter 1 Discussion: Should Dr. Speedy have been issued a citation?

Dr. Speedy, a medical doctor, was recently telephoned to perform emergency surgery on a patient who was just involved in a serious auto accident. Dr. Speedy was told that the patient may not survive if Dr. Speedy does not arrive at the hospital as soon as possible.

Dr. Speedy ignores the local speed limit and drives excessively to arrive at the hospital ASAP.  Officer Friendly radars Dr. Speedy driving 75 m.p.h. in a 15 m.p.h. school zone. This occurred at 2:00 a.m., and no children were seen in the area. Nevertheless, Officer Friendly issues a speeding citation to Dr. Speedy.

In your initial post, explain if you believe Dr. Speedy should have been issued the citation.

I would believe that Dr. Speedy would in-fact deserve a ticket.  I do understand that he was headed to an emergency, but he could have cause another emergency by his reckless actions.  The statutory speed limit was 15 m.p.h. which is set by the law.  He was going 5 times the legal speed limit. In my opinion their is not much of an argument with this particular case.

They are enforceable by law and are applicable even if the speed limit sign is not posted. Examples of statutory speed limits include: 25 mph in residential or school districts,  55 mph on rural highways, and  70 mph on rural Interstate highways. 

I have even a greater concern for the time of day.  Yes i do understand that their are less cars on the roads at that time of day, but it is more likely that the drivers that are on the roads at this hour are impaired.  I feel that the officer in this situation needs to escort the Dr. to the hospital and then issue the situation.  It may be safer with an escort with lights and sirens.
