Global Study Sharia Law Legal Systems the Muslims & Traditional Times Discussion
In 750-1000 words answer the following in an essay form. According to Feldman, shari’a in the traditional Islamic state both signified the rule of law and facilitated checks on political power of rulers. Explain each of those two functions of shari’a as discussed in the Feldman book and lectures. How are the checks on political powers of rulers in the traditional Islamic state different from the checks on political power of leaders in a modern democratic state? Is there a role for shari’a in a Muslim-majority democratic state? If so, what kind of role? If not, explain why.
It goes without saying that there is more than one way of answering this sequence of questions. I am not seeking textbook definitions of concepts, but your own understanding of how different concepts relate to one another. Use your own words and your own thinking as much as you can. You are welcome to draw from outside sources but are in no way obliged to. If you do draw from outside sources make sure you provide appropriate information about each source you use.
I strongly discourage the use of direct quotes in your essays!
