Original Question Sally and Bob are neighbors. Sally is seriously injured when a tall and apparently healthy tree located on Bob’s private property falls on Sally while she sat on her front porch. Assume that Sally sues Bob based on a claim of negligence. In your initial post, explain if Bob is legally responsible for Sally’s injuries. Situations like these are rare but possible. Is it tricky to track down who is actually reliable for this as well. Sally based her claim off of negligence. According to the Chapter Seven PowerPoint, negligence is where “the defendant failed to act reasonably”. Bob is the defendant in this situation and he carelessly neglected his tree knowing something could happen. If the tree was too old, dried out, or had other visible issues before the fall, he could be reliable. However, if the circumstance was different and caused by a natural force such as wind, then Sally would be reliable. She would have to go through her own insurance company.
