Gary, who is nineteen years old, makes the following statement to his friend Ron, who is sixteen years old: “I hereby offer to pay you $10,000 if you don’t smoke any Marijuana for the next six months.” Ron then responded to Gary’s comment by saying “I accept.” This exchange took place in the state of Indiana where Gary and Ron both reside. In the state of Indiana (and also under federal law), it is illegal to possess or consume marijuana. The age of majority in Indiana is 18. After agreeing to Gary’s terms, Ron successfully refrains from smoking marijuana for the specified period. Upon doing so, Ron calls Gary and says “I did it! Now pay up!” Gary refused to pay. Now Ron is considering filing a lawsuit against Gary for breach of contract.
