Grossmont College Interrogation of Darian Wells Case Study

 

BACKGROUND:

Detective Francine Brown was assigned the Winter Jones case. She was informed that WELLS was arrested for DUI and the warrant for 243 (d) PC she had filed. WELLS was involved in a serious crash which required surgery and delayed her contact with him. While in the hospital, a guard was placed outside of WELL’s room. Four days after the crash, Mercy hospital informs Detective Brown that WELLS is conscious and coherent, and is stable enough to be questioned. Brown is on her way to the hospital. She is taking a tape recorder to audio record the interview. She must read him his Miranda rights before questioning him. WELLS agrees to talk to her.

INSTRUCTIONS:

  • After carefully reading Officer Vasquez’s and Detective Brown’s reports, and 243(d) PC, do the following: (NUMBER YOUR QUESTIONS)
  • Write eight questions you would ask WELLS to prove he committed 243 (d) PC. DO NOT ASK BIOGRAPHICAL QUESTIONS (like what is your name and how old are you). These questions should show a reasonable person (juror) that WELLS knew Winter, was at the school, did the crime and had a motive to strike her.
