The case study is from Chapter 14, Case #8, page 316. Case analyses are expected to show critical thinking and be adequately supported with at least three (3) correctly cited references and in-text citations to support your thoughts. One of these references may be the textbook. Each paper should include a synopsis of the issue at hand and an analysis of what should happen next for the particular situation. Each paper will be written using APA format and be at least 1-2 double-spaced pages (not including cover sheet, references, etc). The analysis should be in Word, PDF, or RTF format.

Caswell bought a gas grill to give to his friend, Kile, as a birthday present. The grill exploded the first time it was used due to a factory defect, and Kile was injured. The manufacturer of the grill argued that it was not responsible for Kile’s injuries because Kile had not purchased the grill. There was not privity of contract between Kile and the manufacturer.
How would you decide? Explain.
When one receives a gift, the ownership is transferred from the donor to the receiver upon transfer if the item. Under consumer protection laws, if a manufactrurer’s product is defective and hence causes injuries to the owner, the manufacturer should be held accountable. Kile might not have bought it from the manufacturer but since the item was donated to Kile, he can sue so long as is in position to proof that the item was donated by Caswell. And in any case, when there’s a factory defect the manufacturer should be held liable for damages to the consumer.
