Freedom of Speech Case and Law Review
This Case Review is about
the Constitutional right of free speech and whether certain types of
speech are protected or unprotected. That is the crux of free speech –
is it constitutionally protected or is the speech such that the courts
have deemed it “not free speech” and a “compelling interest exists” to
consider this speech unprotected by the Constitution. There are three
cases that form the core legal foundation of this Case Review
(spoken/Frazer, written/Pico and symbolic/Tinker). As always –
independent reading on all cases is encouraged so you can stand on a
firm body of knowledge (Legal Research). There three parallel cases to
research and they are included in the Application Section. You do not need to find parallel cases on your own for the U5 Case Review.
