Strayer University Fundamental Rights in the American History Discussion
I’m working on a Law exercise and need support.
Washington v. Glucksberg (1997) held that
the Court would only review with strict scrutiny laws that burden those
“fundamental” unenumerated rights that are “deeply rooted in this
Nation’s history and tradition” and are carefully described. In your
opinion, is this a proper way to evaluate “fundamental” rights in our
American society today? Why or why not?
